Membership – Terms & Conditions

Definitions:

Businesses: The businesses who have signed up with Us to provide You with discounts on their services.
We/Us/Our: The Lifestyle Card Ltd t/a The Lifestyle Card (Co. No. 11352607) whose registered address is at 38 Bridge Street, Andover, SP10 1BW.
Membership: A digital membership account provided by Us.
You/Your/Member: An individual holder of a valid Membership.

Application:

These terms and conditions govern Your use of the Membership issued by Us, and apply whether the Membership was purchased directly by You or was gifted to You by an organisation/business who has purchased the Membership from Us. Please read the terms and conditions carefully. By using the Membership You agree to be bound by the terms and conditions below. We reserve the right to take any appropriate action deemed necessary if You breach these terms and conditions including cancelling Your Membership without notice.

Offers:

Current participating Businesses and offers are advertised on Our website but these may vary from time to time. Whilst We endeavour to update Our website regularly, We cannot be held responsible if You cannot claim an advertised discount. Please refer to thelifestylecard.co.uk for the current discounts and venues and check directly with participating Businesses to avoid disappointment.

Our Services:

We offer a 1-year (365 days) Membership or a monthly Membership.

A 1-year (365 days) Membership costs £40. Where you choose a 1-year (365 days) Membership, Your Membership will not automatically renew and will expire at the end of this period. Shortly before the end of your membership period, We will notify you when Your Membership is about to expire, giving you the option to renew.

A monthly Membership costs £3.75 per month. This is a rolling Membership and You will be charged for Your Membership every month until You cancel Your subscription. It is Your responsibility to ensure that Your payment information is kept up to date, using Your online account, to enable us to take payment.

Payment for Your Membership is taken using Stripe (an online payment provider).

Once an order is placed with Us for a Membership You will have instant access to your Membership including Your digital card. Your online account will give You full access to Your Membership details, including Your chosen subscription.

We may, at our sole discretion, refuse to issue a Membership and may withdraw Your Membership at any time.

Use of Membership:

The Membership may only be used until the expiry date stated within Your account and any offer associated with Your Membership can only be used by You once in any transaction. A participating Business may request proof of identification, and this is a matter for the Business itself. You should inform a participating Business that You wish to use the Membership prior to purchase and certain Businesses and offers may require pre-booking.

Membership is non-transferable and so cannot be used by either friends or other third parties, apart from direct spouse or partner.

We shall not be liable for any losses You suffer where You have provided someone else with the means to use Your Membership, with or without Your permission.

Discounts may not be redeemed for cash and the Membership cannot be used in conjunction with any other promotions being offered by the participating Business.

You must be 16 years old or over to hold a Membership.

Your Behaviour:

You are expected to behave in a responsible and respectful manner when visiting participating Businesses and when using the Membership. In the event of damage to premises or other losses caused by You to participating Businesses, We will co-operate with the participating Businesses and You consent to Us sharing Your contact details with the Business in these situations.

Cancellation:

We offer a 14-day cooling-off period from the date of receipt in which You can cancel Your Membership and request a full refund. The Membership can only be cancelled if it has not been used to obtain any discounts from participating Businesses. If You use the Membership to obtain any discounts You will have lost Your right to cancel.

After this 14-day period You have the right to cancel the Membership at any time however a refund will not be issued for any remaining balance of Your Membership period.

To cancel the Membership, please either:

  • contact Us directly at info@thelifestylecard.co.uk, including Your name and member ID; or
  • update Your details through the subscriptions section in Your online account, My Account.

Our Liability:

We work with Businesses to secure discounts for You on services provided by those businesses. Any transactions that take place between You and a Business are conducted with the Business directly and We are not a party to the contract formed between You and the Business. In the event of any dispute or complaint as to the service or goods provided by the Business, or any other claims or disputes, these should be raised by You directly with the Business concerned.

Whilst We only partner with Businesses We consider reputable and trustworthy We are not a vetting organisation and take no responsibility for the quality of goods and services they provide. It is Your responsibility to use Your own judgment in this respect.

We accept no liability You may incur for charges, fines, penalties or interest as a result of the automatic monthly renewal, should You choose a monthly membership. It is Your responsibility to ensure that You always have sufficient funds to cover Your monthly subscription.

Nothing in these terms and conditions shall limit or exclude Our liability for death or personal injury caused by Our negligence or for fraud or fraudulent misrepresentation. Subject to this, We shall under no circumstances whatsoever be liable to You, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for: loss of profits, loss of sales or business, loss of agreements or contracts, loss of anticipated savings, loss of use or corruption of software, data or information, loss of or damage to reputation or goodwill or indirect or consequential loss arising under or in connection with this agreement.

Our total liability to You in respect of all other losses arising under or in connection with this agreement, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the total of the amount paid for the purchase of Your Membership.

Use Of Your Personal Data:

By registering for a Membership You will be asked to provide certain personal information, which may include your name, mobile telephone number, email address, postal address and date of birth. This information is required in order for Us to perform Our obligations pursuant to Our agreement with You.

We do not share Your personal data with third parties save where required to do so by law, to perform Our obligations to You or as otherwise provided in these terms and conditions (in particular see “Your Behaviour”). We will store Your personal data on Our internal electronic storage which will be password protected and encrypted.

Any information that you supply to Stripe in order to process Your payment to Us will be processed according to Stripe’s data protection policy. We will not have access to or be provided with this information by Stripe.

Additional Terms For Employers/Organisations:

For employers/organisations who purchase Membership on behalf of employees/members, We will only issue one Membership per employee/member and the employee/member shall be treated as “You” for the purposes of these terms and conditions.

Where an employer/organisation purchases Membership for its employees/members the employer/organisation warrants that it has the individual’s consent to share their personal data with Us as outlined above and shall indemnify Us against any losses arising if this is not the case.

Additional Terms For Holders Of Physical Membership Cards:

You can request a physical card as part of Your Membership application. If You have requested a physical card it will be posted to You within 7 working days of receipt of a successful application from You. Please note that there is an additional charge if You wish to purchase a physical card directly from Us and we will notify You of this at the time of receipt of your request.

Any physical card that is issued to You is issued by Us and remains Our property at all times.

In the event of a lost, stolen or damaged physical card, please contact Us and We will create You a duplicate physical card at an additional cost. We accept no liability for lost, stolen or damaged cards.

Your physical card must be returned upon cancellation of Your Membership before any refund can be authorised. We cannot be responsible for any postage costs in returning the card to Us.

General:

These terms and conditions and any document expressly referred to in them constitute the whole agreement between You and Us and supersede any previous correspondence or discussions.

We reserve the right to alter or amend these terms and conditions at any time without giving notice to You. You should refer to Our website for the prevailing terms and conditions at any given time.

We reserve the right to withdraw the Membership scheme or to add or remove participating Businesses at any time.

These Terms shall be governed and construed in accordance with the laws of England and Wales and any disputes howsoever arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
